Pursuant to sections 116 and 117 of the Public Works
Act 1981 and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information
New Zealand, declares the portion of road described in the First Schedule to this notice to be stopped and, pursuant to section 120 (3), amalgamated with the land in Computer Freehold Register NA12C/178, subject to a stormwater easement in gross in favour of the Whangarei District Council over the area marked “A” on DP 345811 under the rights and powers described in the Second Schedule, mortgage C950490.1 and Computer Freehold Register 5640846.1.

Second Schedule
Easement rights and powers are those prescribed by the Fourth Schedule to the Land Transfer Regulations 2002, modified by the additional condition that any maintenance, repair or replacement of the stormwater line that is necessary because of any act or omission by the owner of the servient land (which includes any agents, employees, contractors, subcontractors or invitees of the owner) must be carried out promptly by that owner at the sole cost of that owner or in such proportion as relates to the act or omission.
