Notice is hereby given, in accordance with section 94 (2) of the Motor Vehicle Sales Act 2003, that a Motor Vehicle Disputes Tribunal has found against the following motor vehicle traders:
MVD 004/05Decision No.: Wn 61/05 Highgate Motors Limited (Richard John Byrne) Highgate Motors Limited is ordered to pay the purchaser compensation of $1,248.30 plus damages of $500.00. Highgate Motors Limited and Richard John Byrne jointly to pay the purchaser damages of $3,864.00.
MVD 008/05Decision No.: Ak 68/05 Voyager Motors Limited Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay the purchaser $12,000.00 plus compensation of $1488.98.
MVD 098/05Decision No.: Ak 183/05 Paghman Oryhkil Limited (trading as Paghman Motors) Ordered that the trader pay the purchaser the sum of $1,230.00, any capital payments plus insurance refunds plus costs of $50.00.
MVD 148/05Decision No.: Ak 185/05 George Molloy Autos Limited Ordered that the trader pay the purchaser compensation of $55.00.
MVD 190/05Decision No.: Ak 192/05 Kiwi Auto Auctions Limited Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay the purchaser $6,700.00 plus compensation of $1,930.63 plus insurance refunds.
MVD 198/05Decision No.: Ak 180/05 Auto Point Limited Ordered that the trader pay the purchaser $1,130.62 and costs of $50.00.
MVD 205/05Decision No.: Wn 71/05 Quadrant Holdings Limited (trading as Gisborne Auto Court) Ordered that the trader pay the purchaser damages of $3,000.00.
MVD 211/05Decision No.: Ak 184/05 Universal Imports (1998) Limited Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay the purchaser $3,700.00 plus compensation of $549.01 plus insurance refunds plus costs of $50.00.
MVD 215/05Decision No.: Wn 62/05 Cars 2 Go Rescission ordered – ordered that the trader pay the purchaser $6,750.00.
MVD 228/05Decision No.: Ak 188/05 Trademark Autos Limited Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay the purchaser $2,800.00 plus compensation of $161.65 plus insurance refunds plus costs of $50.00.
MVD 238/05Decision No.: Ak 199/05 Giltrap Motors Limited (trading as Giltrap Holden) Rescission ordered – ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay the purchaser $35,150.00.
