Anti-dumping Duties: Notice That Anti-dumping Duties on Household Refrigerator-Freezers and Refrigerators From Korea May Cease to Apply

Under section 14 (9) of the Dumping and Countervailing Duties Act 1988 (“the Act”), anti-dumping duties imposed on household refrigerator-freezers and refrigerators from Korea* will cease to apply to those goods on 10 June 2006 unless, at that date, the goods are subject to review under section 14 (8) of the Act.
Any interested party that might request that the Chief Executive of the Ministry of Economic Development initiate a review before the cessation date referred to above,
should be aware that positive evidence justifying the need for a review must be provided to the chief executive.
If an application is received which provides positive evidence justifying the need for a review, the chief executive must undertake and complete a review investigation within 180 days of initiation, on whether the anti-dumping duties should continue to be applied.
Positive evidence justifying the need for a review would need to include reasons for believing that the expiration of anti-dumping duties would see the continuation or recurrence of dumping of refrigerator-freezers and refrigerators from Korea, and for believing that such dumping would be likely to cause the continuation or recurrence of material injury to the New Zealand industry producing refrigerator-freezers and refrigerators.
The reasons should be supported by evidence and not be based on mere allegations or assertions.
