Fisheries (Quota Aggregation Limit Exemption) Notice (No. 2) 2005 (No. F347)

Pursuant to section 60 of the Fisheries Act 1996, the Minister of Fisheries, after consultation with representative organisations that have an interest in section 60, and after consideration of the matters specified in section 60 (3) of the Fisheries Act 1996, hereby gives the following notice.
N o t i c e
1. Title and commencement—(1) This notice may be cited as the Fisheries (Quota Aggregation Limit Exemption) Notice (No. 2) 2005 (No. F347).
(2) This notice shall come into effect on the day after its notification in the New Zealand Gazette.
2. Interpretation—In this notice, “Burkhart Fisheries” means Dennis Lindsay Burkhart, Trevor Milton Burkhart, Burkhart Fisheries Limited, and Lanfar Holdings (No. 4) Limited, and includes any persons associated with these persons and companies in terms of section 59 (10) of the Fisheries Act 1996.
3. Exemption to quota aggregation limit increased for
five years—Notwithstanding Fisheries (Quota Aggregation Limit Exemption) Notice (No. 2) 2001 (No. F186), as from the date that this notice comes into effect and for a period of five years after that date, Burkhart Fisheries is permitted to own quota shares in spiny rock lobster in quota management area 5 in excess of the amount referred to in that notice, up to the limit of 26,890,000 quota shares.
4. Avoidance of doubt—For the avoidance of doubt, at the conclusion of the period of five years referred to in clause 3 of this notice, the quota aggregation limit for Burkhart Fisheries for spiny rock lobster in quota management area 5, reverts to an aggregation limit of 25,036,000 of the total transferable quota for spiny rock lobster in quota management area 5.
