Pursuant to Regulation 9 of the Radiocommunications Regulations 2001 (“the Regulations”) made under section 116 (1) (b) of the Radiocommunications Act 1989, and acting under delegated authority from the chief executive,
I give the following notice.
N o t i c e
1. Short title and commencement—(1) This notice is the Radiocommunications Regulations (General User Radio Licence for Satellite Services) Notice 2005.
(2) This notice comes into force on 14 October 2005.
2. General user radio licence—A general user radio licence is granted for the transmission of radio waves for the purpose of:
? Mobile Satellite Services (MSS);
? Satellite News Gathering services (SNG); and
? Very Small Aperture Terminal satellite services (VSAT);
being handheld, portable, transportable (vehicle mounted and re-locatable) and fixed radio transmitters, in accordance with the terms, conditions and restrictions of this notice.
3. Terms, conditions and restrictions—(1) The ranges of frequencies permitted pursuant to this licence are those prescribed in the First Schedule to this notice.
(2) The limits of transmit power and emission bandwidth
for SNG and VSAT transmitters permitted pursuant to this licence are those prescribed in the Second Schedule to
this notice.
(3) Transmitters must conform to technical standards as prescribed by the respective satellite service provider, and any applicable standards as prescribed in notices made under Regulation 32 (1) (b) of the Regulations.
(4) Transmitters must conform to operational technical specifications equal to or better than those notified to and favourably co-ordinated with the ITU-R Radiocommunciation Bureau in accordance with Article 11 of the International Radio Regulations.
(5) Frequency use is on a shared basis and the chief executive does not accept liability under any circumstances for any loss or damage of any kind occasioned by the unavailability of frequencies, or interference to reception.
(6) Should interference occur to services licensed pursuant to a radio licence or a spectrum licence, the chief executive reserves the right to require and ensure that any transmissions pursuant to this general user radio licence change frequency, reduce power, or cease operation.
(7) In the band 14,000 – 14,500 MHz, MSS must not cause interference to, nor claim protection from, stations operating as SNG and VSAT Fixed Satellite Services.
4. Consequential revocation of licences—(1) The Radiocommunications Regulations (General User Radio Licence for Mobile Satellite Service) Notice 2003, published in the New Zealand Gazette, 26 June 2003, No. 73, page 1887, is revoked.
(2) Notwithstanding the revocation of that notice under subsection (1), every transmitter compliant with the requirements of that notice on the commencement date of this notice is deemed to be compliant with the requirements of this notice.

This notice prescribes that, pursuant to regulation-making powers of the Radiocommunications Act 1989, a general user radio licence is granted for the transmission of radio waves for the purpose of the Mobile Satellite Service, Satellite News Gathering Service and Very Small Aperture Satellite Services being handheld, portable, transportable (vehicle and re-locatable) and fixed radio transmitters, in accordance with the terms, conditions and restrictions of this notice.
