Notice is hereby given, in accordance with section 94 (2) of the Motor Vehicle Sales Act 2003, that a Motor Vehicle Disputes Tribunal has found against the following motor vehicle traders:
MVD 217/04 Decision No: Ak 71/05 Fiaola Motors Limited Ordered that the trader pay the purchaser $1,000.00 plus any capital payments and costs of $50.00.
MVD 348/04Decision No: Wn 40/04 Michael Bolton Cars Limited Ordered that the trader collect the vehicle from the purchaser at the trader’s expense and pay the purchaser the sum of $12,000.00.
MVD 353/04Decision No: Ak 54/05 Nippon Autos Limited Ordered that the trader pay the purchaser the sum of $5,419.00 plus $200.00 reimbursement of capital payments plus compensation of $275.00 and costs of $50.00.
MVD 386/04Decision No: Ak 28/05 Nippon Car Wholesalers Limited Trader to pay the purchaser any capital payments plus costs of $50.00.
MVD 46/05 Decision No: Ak 78/05 YDL Enterprises NZLimited (trading as Ace Motors) Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay the purchaser $17,250.00 plus any capital payments plus insurance refunds plus compensation of $483.92 and costs of $50.00.
MVD 100/05Decision No: Ak 136/05 Premier Autos Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay the purchaser any capital payments plus insurance refunds plus compensation of $250.00 and costs of $50.00.
MVD 105/05Decision No: Ak 144/05 Mike McColl (trading as Shore European) Ordered that the trader pay the purchaser the sum of $1,604.70 plus costs of $50.00.
MVD 126/05Decision No: Ak 147/05 Sales Motor Group Limited Ordered that the trader repair the vehicle to an acceptable quality to gain a warrant of fitness. Purchaser liable for repairs to the vehicle as a result of the accident.
MVD 135/ 05Decision No: Wn 45/05 Formation Holdings Limited (trading as Celica Motors) Rescission ordered. Trader to pay the purchaser any capital payments.
MVD 137/05Decision No: Ak 47/05 Tarnica Cars Limited Rescission ordered. Trader to pay the purchaser any capital payments.
MVD 146/05Decision No: Ak 140/05 New Zealand Car Importers & Wholesalers Limited Ordered that the trader pay the purchaser $1,000.00 plus any capital payments plus insurance refunds plus compensation of $2,055.15 and costs of $50.00.
MVD 152/05Decision No: Ak 141/05 Gils Finance Limited Ordered that the trader pay the purchaser $1,300.00 plus any capital payments plus insurance refunds plus compensation of $787.22 and costs of $50.00.
