Notice of Confirmation of Electricity Governance Amendment Rules (No. 21) 2005 and Notice of Reasons for Decision

1. Pursuant to section 172E (3) (b) of the Electricity Act 1992 (“Act”), I notify that the Electricity Governance Amendment Rules (No. 21) 2005 (“Amendment Rules”), which were made under urgency in accordance with section 172E (3) of the Act on 24 March 2005, will not be revoked, replaced or amended.
2. Pursuant to section 172E (3) (b) of the Act, the reasons for my decision not to revoke, replace or amend the Amendment Rules are that:
(a) no submissions received on the Amendment Rules identified any concerns that need to be addressed by revoking, replacing or amending the Amendment Rules; and
(b) the reasons for making the Amendment Rules remain valid in that:
(i) Transpower has advised that it requires additional time to complete the proposed transmission pricing methodology this year, due to the limited staff resources available to complete the work required, and the potential for competing resource requirements to meet other regulatory requirements of both the Electricity and Commerce Commissions; and
(ii) it is conceivable that 90 days may also not be sufficient in future years, particularly if there are further changes to the Part F framework
in the Rules which impact on the preparation of the transmission pricing methodology.
3. Copies of the Electricity Governance Rules 2003 may be inspected free of charge or purchased from the Electricity Commission, Level Seven, ASB Bank Tower, 2 Hunter Street, Wellington, and these Rules can also be viewed on the Electricity Commission web site:
