Civil Aviation Rules—Notification of

Ordinary Rules and Consequential Amendments
In accordance with section 34 (1) (a) of the Civil Aviation Act 1990, the Minister for Transport Safety hereby gives notice of his intention to make the following Ordinary Civil Aviation Rules:
Part 43—General Maintenance Rules – various amendments to the rule requirements prescribed in Part 43 regarding the performance of maintenance and persons who may perform maintenance. This includes provision for maintenance to be performed in another State that is party to a technical arrangement with
New Zealand (NPRM 05-04, Docket 1/CAR/1357).
Consequential Amendments:
Part 1—Definitions and Abbreviations – various amendments to existing definitions and the addition of new definitions relating to the maintenance and airworthiness requirements for aircraft.
Part 91—General Operating and Flight Rules –minor amendments to operating and general flight rules regarding airworthiness and time-in-service recorder requirements and significant amendments
to subpart F regarding Instrument and Equipment Requirements, and subpart G regarding Operator Maintenance Requirements.
Part 145—Aircraft Maintenance Organisation – Certification – various minor amendments regarding personnel duty times, maintenance control procedures, authorisation procedures, records and exposition requirements.
Part 21—Certification of Products and Parts – various amendments regarding the type certification, type acceptance certification, and airworthiness certification of aircraft (NPRM 05-05, Docket 1/CAR/1357).
Consequential Amendments:
Part 26—Additional Airworthiness Requirements – minor changes to terminology and deletion of inappropriate requirements regarding applicants for type certificates and type acceptance certificates. Also a significant change to upgrade the fire safety standards for cargo and baggage compartments.
Part 39—Airworthiness Directives – a complete reissue of Part 39 to remove potential conflicts with the Act and to require automatic compliance
with foreign airworthiness directives for aircraft over 5700kg MCTOW.
Part 146—Aircraft Design Organisation – Certification – minor amendments to delete unnecessary requirements and to clarify the organisation changes that require the Director’s acceptance.
Part 148—Aircraft Manufacturing Organisation – Certification – various minor amendments to delete redundant rules, correct and clarify some rules, and include some requirements regarding priority parts.
Part 119—Air Operator – Certification – various amendments to the requirements relating to the maintenance responsibilities of an Air Operator Certificate holder (NPRM 05-06, Docket 1/CAR/1357).
Consequential Amendments:
Part 103—Microlight Aircraft – Certification and Operating Rules – amendments regarding flight permit airworthiness requirements and maintenance inspection requirements for equipment.
Part 104—Gliders – Operating Rules – amendments regarding test flights, flight manuals, and equipment and maintenance requirements.
Part 121—Air Operations – Large Aeroplanes – amendments relating to maintenance requirements.
Part 125—Air Operations – Medium Aeroplanes –additional instrument and equipment requirements regarding protective breathing equipment, amendments relating to maintenance requirements, and a correction to the FDR decision chart.
Part 135—Air Operations – Helicopters and
Small Aeroplanes – amending the instrument
and equipment requirement regarding seating and restraints for helicopter crew, clarification of the options for maintenance, and amending requirements regarding maintenance review and annual review of airworthiness.
Part 137—Agricultural Aircraft Operations – minor amendment regarding maintenance for operations over congested areas.
Comments on the proposed rules should be submitted to the Docket Clerk by 20 June 2005.
