Notice of Making of Electricity Governance Amendment Rules (No. 16) 2004 and

Notice of Reasons for Decision
1. Pursuant to section 172I of the Electricity Act 1992,
I notify the amendment of the Electricity Governance Rules 2003 ("Rules") under section 172H of the Electricity
Act 1992.
2. The empowering provisions for the electricity governance regulations in relation to which the Rules are amended are sections 172D (1) (6) of the Electricity Act 1992.
3. A brief description of the nature of the amendment follows:
The amendment consists of the inclusion of the grid investment test as a Schedule to section III of Part F of the Rules, as required by Rule 6 of section III of Part F.
4. Pursuant to section 172Z (4) of the Electricity Act 1992, the reasons for my decision to amend the Rules are that:
? I consider that the insertion of the grid investment test as a Schedule to section III of Part F of the Rules is the most appropriate grid investment test, as determined by the Electricity Commission ("Commission"), to be applied by:
? the Commission in developing grid reliability standards;
? Transpower, to determine proposed economic investments for inclusion in the proposed grid upgrade plan;
? the Commission, to review and approve reliability investments and economic investments; and
? the Commission, to review transmission alternatives.
5. These Rules come into force on 11 February 2005.
6. Copies of the Rules, including this amendment, may be inspected free of charge or purchased from the Electricity Commission, Level Seven, ASB Bank Tower, 2 Hunter Street, Wellington.
