Take notice that on the 23rd day of November 2004, an application for an order, under section 174 of the Companies Act 1993, in respect of Debon Holdings Limited was filed in the High Court at Christchurch.
The order sought is an order that:
(a) Bonnie Anne Williams be removed as director;
(b) That the resolution appointing Kevin Williams as project manager be rescinded and Kevin Williams removed as project manager of the Claremont Development;
(c) That the offer to purchase Lot 13 by Chris Rowe for $250,000.00 be accepted by the defendant company;
(d) That the applicant's costs of and incidental to this proceeding be met by the defendant company; and
(e) Any other order that the Court thinks fit to make as it considers just and equitable in the circumstances.
The application is to be heard before the High Court at Christchurch on the 31st day of January 2005 at 10.00 a.m.
Any person, other than the defendant company, who wishes to appear on the hearing of the application must file an appearance no later than the second working day before
that day.
