Reinstatement of Company to the Register of Companies
Companies Act 1955
The name of the following company was reinstated to the Register of Companies on the 19th day of July 2004:
Moda Secura Limited (statutory receiver appointed and in liquidation). 252405.
It had been removed, under section 293 (1) (c) (i) of the Companies Act 1955, on the grounds that no liquidator was acting.
This was incorrect.
The statutory receivership under the Companies Special Investigations Act 1958 and the liquidation were continuing.
Formal conclusion of the statutory receivership requires an Order in Council, which removal prevented.
The procedure for removal was null and void (refer Re Crott's Application (1991) 5 NZCLC 67,325) and it is proper that the Register be corrected by reinstatement.
