Land Transfer Act Notice

The applicants described below have applied, under section 70 of the Land Transfer Act 1952, for the removal of
a redundant easement. It is contended by the applicants that the easement is redundant by reason of the circumstances set out below. I intend to remove the easement at the expiry of one calendar month from the date of the publication of this notice in the New Zealand Gazette and provided that there is no objection lodged by anyone before that date.
Application: 6191951.1.
Applicants: William James Burton and Robert John Burton.
Description of the Easement: A right of way easement over part Lot 2, DP 34528 (Computer Freehold Register NA7D/1235) appurtenant to Lot 3, DP 59622 (Computer Freehold Register NA18D/28) created by Transfer A123102.
Circumstances: The continuity of the right of way easement was broken by the deposit of Plan 59622 and the creation of Lot 3 in the same plan. As a consequence, the right of way easement as described became redundant.
