Land Transfer Act Notice

The applicants described below have applied, under section 70 of the Land Transfer Act 1952, for the removal of an
easement. The applicants claim that the easement is redundant by reason of the circumstances set out below. I intend to
remove the easement on the 26th day of August 2004, if no objections have been received before that date.

Applicants: Andrew James Field, Janette Kathryn Field and Stuart John Gilmour.
Description of Easement: Right of way over (now) part Lot 1, DP 2718 (comprised in Computer Register HBM4/107) created by Transfer 23886 on the 12th day of November 1912. The easement was originally appurtenant to the balance of certificate of title HB27/130 (cancelled November 1912). The line of the easement appears on DP 2718, reconstituted
in 1966.
Circumstances: The original dominant tenements are no longer identifiable due to the destruction of the Hawke's Bay land records in 1931. No current Computer Register appears to have any appurtenant right of way created by Transfer 23886. The applicants claim that the right of way is not formed and is no longer in use.
