Under the Reserves Act 1977, Tauranga City Council, which changed its name from Tauranga District Council by virtue of Local Government (Tauranga City Council) Order 2003:
(a) In exercise of the powers conferred on it by delegation, under section 16 (1) of the said Act, hereby classifies the land set out in the First Schedule below as recreation reserve within the meaning of the said Act and, under section 52 (1) of the said Act, declares that the recreation reserves described in the First and Second Schedules below be united to form one reserve; and
(b) Under section 16 (10) of the said Act, declares that the united recreation reserves described in the First and Second Schedules below shall be known as Memorial Park.
South Auckland Land District-Tauranga District
First Schedule
3.3426 hectares, being part Block 28, Church Mission Reserve, Town of Tauranga and Lots 1-10, Deposited Plan 17466 and Lots 1-8, Deposited Plan 29918, all certificate of title SA61084.
Second Schedule
7.7810 hectares, being Allotments 734, 775-782, 785-788, 878-880, and all being part of Section 2, Town of Tauranga, and Lots 1-3, Deposited Plan S. 1829, all certificate of title SA61085. Subject to certificate B. 623418.1, section 36 (2) of the Building Act 1991.
