Notification of Issue of the Minerals Programme for Petroleum 2005

Pursuant to section 19 of the Crown Minerals Act 1991,
I hereby give notice that the Governor-General, by Order in Council dated the 6th day of December 2004, has issued
the Minerals Programme for Petroleum ("the programme"), with the programme to take effect from 1 January 2005.
The programme establishes the policies, procedures and provisions to be applied in respect of the allocation
and management of petroleum, in particular:
(a) the efficient allocation of rights in respect of petroleum; and
(b) the Crown obtaining a fair financial return from petroleum.
The following items are included within the programme:
? An outline of the policy framework within which decisions relating to the management of the country's petroleum resource are to be made.
? The procedures for how the Crown will consult with hapu and iwi as a Treaty partner in relation to the issue of new permits, permit allocation and procedures for gaining access to land.
? Methods of allocating petroleum permits, including matters to be taken into consideration when evaluating applications.
? The application of conditions to the allocation of permits.
? Procedures for granting changes to permits.
? Procedures for coping with permit holders who do not comply with permit conditions.
? Royalty provisions to apply to oil and gas production.
? A detailed summary of the reasons for and against adopting the allocation framework.
? A detailed summary of the reasons for and against adopting the royalty regime.
The programme replaces the Minerals Programme for Petroleum published in the New Zealand Gazette,
21 December 1994, page 4467.
The programme applies to all permit applications for petroleum received by the Crown from 1 January 2005 onwards, and to any permit holder who elects to switch from the Minerals Programme for Petroleum (1 January 1995).
