Fisheries (Declaration of Mataitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2004 (No. F310)

Pursuant to Regulations 20, 21 and 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister of Fisheries hereby gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice may be cited as the Fisheries (Declaration of Mataitai Reserve and Appointment of Tangata Tiaki/ Kaitiaki) Notice 2004.
(2) This notice shall come into effect on the day after the date of its notification in the New Zealand Gazette.
2. Interpretation-In this notice:
(a) "mataitai reserve" means the identified traditional fishing ground described in clause 3 of this notice.
(b) "Tangata Tiaki/Kaitiaki" means any person or persons appointed as Tangata Tiaki/Kaitiaki for the mataitai reserve under Regulation 21 of the Fisheries (South Island Customary Fishing) Regulations 1999.
(c) "excluded areas" means:
(i) the areas comprising 1075.1 hectares shown by "A", "B" and "C" on the registered Survey Plan SO 337996 (attached to this notice) and declared to be a marine reserve under the Marine Reserve (Ulva Island-Te Wharawhara) Order 2004; and
(ii) those waters of Big Glory Bay generally southward of a line from the point west of Sailors Rest (46 58.09'S 168 08.42'E), then generally in a north-westerly direction to the
north-eastern point of Bravo Island (46 57.42'S 168 08.45'E), then following the mean high water spring line in a westerly direction along the shore of Bravo Island to a point (46 57.35'S 168 08.13'E), then generally west across the sand spit to the nearest land at (46 57.42'S 168 08.45'E).
3. Declaration of a mataitai reserve-The Minister of Fisheries hereby declares a mataitai reserve at Te Whaka a Te Wera (Paterson Inlet), Stewart Island.
The mataitai reserve encompasses all the coastal waters of Paterson Inlet, Stewart Island, lying to the south-west of a straight line drawn from Ackers Point (46 53.74'S 168 09.86'E) to Bullers Point (46 55.21'S 168 11.65'E), but does not include the excluded areas.
4. Appointment of Tangata Tiaki/Kaitiaki-Phillip John Smith, Maureen Winifried Okeroa Jones, Richard Graham Squires and Peter Godword Goomes are hereby appointed as Tangata Tiaki/Kaitiaki for the above mataitai reserve.
5. Commercial fishing prohibited area-Commercial fishing within the above mataitai reserve is hereby prohibited under Regulation 24 of the Fisheries (South Island Customary Fishing) Regulations 1999.
6. Power to authorise taking of fisheries resources for customary food gathering-The Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1983 and 1996 for customary food gathering purposes from within the whole or any part of the mataitai reserve. No customary fishing may take place in the mataitai reserve without authorisation from the Tangata Tiaki/Kaitaiki.
