Under section 159N (4) and section 159Y (3) of the Education Act 1989, the Associate Minister of Education (Tertiary Education) and the Tertiary Education Commission (TEC) give the following notice.

1. This notice may be cited as the Education (Exemptions From 2005 Tertiary Charter and Profile Requirements for Identified Schools Affected by Network Reviews) Notice 2004.
2. This notice applies from the date of its publication and expires on 31 December 2005.
Introduction
All organisations that seek or receive funding from the TEC must have an approved charter and profile unless exempt from the requirement to have a charter and profile.
Schools Identified as Affected by Network Reviews
The Minister exempts the following schools affected by
the Ministry of Education Network Reviews from the requirement to prepare and submit a tertiary charter for approval. The TEC similarly exempts these schools from
the requirement to submit a profile:
Invercargill New School
Taihape Area School
Okato Area School
Putaruru College
Waitaki Valley School
