Fisheries (Kaimoana Customary Fishing) Notice (No. 16) 2004 (No. F288)

Pursuant to Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, and acting under delegated authority, a Senior Fisheries Management Advisor, Ministry of Fisheries, hereby gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 16) 2004.
(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.
2. Interpretation-In this notice:
(a) "Kaitiaki" is a local dialect word that has the same meaning as "Tangata Kaitiaki/Tiaki", a term that is defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(b) Any reference to "Kaitiaki" means the person
or persons appointed under Regulation 9 of
the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of customary food gathering within the area/rohe moana.
(c) The "area/rohe moana" means:
(i) firstly, an area at Kiritehere described by a line commencing at a point on the coastline at Tirua Point (38 23.2'S; 174 38.1'E), then generally northerly following the coastline to the mouth of the Waipaua Stream (38 18.9'S; 174 42.7'E), then due west for 200 nautical miles to the outer limit of the exclusive economic zone, then generally southerly along the outer limit
of the exclusive economic zone to a point due west of the point of commencement, then due east for 200 nautical miles to the point of commencement; and
(ii) secondly, an area at Marokopa described by
a line commencing at a point on the coastline
at the mouth of the Waipaua Stream (38 18.9'S; 174 42.7'E), then generally northerly following the coastline to a point at Harihari Beach (38 13.1'S, 174 42.9'E), then due west extending to the outer limit of the exclusive economic zone, then generally southerly along the outer limit of the exclusive economic
zone to a point due west of the point of commencement, then due east for 200 nautical miles to the point of commencement. The geographical co-ordinates named are in terms of the WGS84 datum.
3. Appointment of Kaitiaki-The Associate Minister of Fisheries (acting pursuant to a delegated authority) hereby confirms the appointment of Tame Hohaia and Alan Willison as Kaitiaki for managing customary food gathering within the area/rohe moana defined above in 2 (c) (i), and George Kete, Hemi Kete, Tom King and Greg Martin as Kaitiaki for managing customary food gathering within the area/rohe moana defined above in 2 (c) (ii).
4. Confirmation of tangata whenua-Ngati Kinohaku, Ngati Te Kanawa and Ngati Peehi, as represented by the Marokopa Marae, are confirmed as the tangata whenua of the area/rohe moana to which the appointment of Kaitiaki relates.
5. Power to authorise the taking of fisheries resources for customary food gathering-The Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996, other than those resources that are taken in fresh water, for customary food gathering purposes from within the whole or any part of each area/rohe moana for which they have been appointed as Kaitiaki. No customary food gathering of fisheries resources may take place in the area/rohe moana without an authorisation from the Kaitiaki.
