Fisheries (South Island Customary Fishing) Notice (No. 55) 2004 (No. F283)

Pursuant to Regulations 9 and 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, and acting under delegated authority, the Associate Minister of Fisheries hereby gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 55) 2004.
(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.
2. Interpretation-In this notice:
(a) "customary food gathering" has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999.
(b) "Tangata Tiaki/Kaitiaki" means the person or persons appointed under Regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999 as Tangata Tiaki/Kaitiaki for the management of a general customary food gathering area/rohe moana, as described in clauses 3 and 5.
3. Cancellation of Tangata Tiaki/Kaitiaki-Te Runanga
o Otakou, being the tangata whenua who nominated Terence Leonard Broad, William Robert Loper, Edward Martin Palmer, Raewyn Ann Harris, William Boyd Russell, Matenga Teone Taiaroa and Tatane Alex Tarewai Wesley
as Tangata Tiaki/Kaitiaki for the area/rohe moana, has requested in writing the cancellation of their appointments as Tangata Tiaki/Kaitiaki for the following areas/rohe moana:
(a) Terence Leonard Broad, Tatane Alex Tarewai Wesley, Raewyn Ann Harris, William Boyd Russell and Matenga Teone Taiaroa as Tangata Tiaki/Kaitiaki of the customary food gathering area/rohe moana from Heywood Point to Blackhead, extending seaward to the limit of the South Island fisheries waters as defined under Regulation 2 of
the Fisheries (South Island Customary Fishing) Regulations 1999, and inland to boundaries defined for Te Runanga o Otakou under Te Runanga o Ngai Tahu Act 1996;
(b) William Robert Loper as Tangata Tiaki/Kaitiaki of the customary food gathering area/rohe moana from Blackhead to Kuri Bush, extending seaward to the limit of the South Island fisheries waters as defined under Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999, and inland to boundaries defined for Te Runanga o Otakou under Te Runanga o Ngai Tahu Act 1996;
(c) Edward Martin Palmer as Tangata Tiaki/Kaitiaki of the customary food gathering area/rohe moana from Kuri Bush to the Tokomariro River mouth, extending seaward to the limit of the South Island fisheries waters as defined under Regulation 2 of
the Fisheries (South Island Customary Fishing) Regulations 1999, and inland to boundaries defined for Te Runanga o Otakou under Te Runanga o Ngai Tahu Act 1996.
4. Cancellation of appointment-The Associate Minister of Fisheries hereby confirms the cancellation of the appointments of Terence Leonard Broad, William Robert Loper, Edward Martin Palmer, Raewyn Ann Harris, William Boyd Russell, Matenga Teone Taiaroa and Tatane Alex Tarewai Wesley as Tangata Tiaki/Kaitiaki for managing customary food gathering within these areas/rohe moana.
5. Nomination of Tangata Tiaki/Kaitiaki-Te Runanga
o Otakou, being the tangata whenua holding manawhenua manamoana over the area/rohe moana from Heywood Point to the Koau Branch of the Clutha River, extending seaward to the limit of the South Island fisheries waters as defined under Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999, and inland to boundaries defined for Te Runanga o Otakou under Te Runanga o Ngai Tahu Act 1996, have nominated Hoani Sydney Langsbury, Tony Ropata and Trevor Griffin as Tangata Tiaki/Kaitiaki for managing customary food gathering within the following areas/rohe moana:
(a) Hoani Sydney Langsbury as Tangata Tiaki/Kaitiaki for the customary food gathering area/rohe moana from Heywood Point to Blackhead, extending seaward to the limit of the South Island fisheries waters as defined under Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999 and inland to boundaries defined for Te Runanga o Otakou under Te Runanga o Ngai Tahu Act 1996;
(b) Tony Ropata as Tangata Tiaki/Kaitiaki for the customary food gathering area/rohe moana from Blackhead to Kuri Bush, extending seaward to the limit of the South Island fisheries waters as defined under Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999, and inland to boundaries defined for Te Runanga o Otakou under Te Runanga o Ngai Tahu Act 1996;
(c) Trevor Griffin as Tangata Tiaki/Kaitiaki for the customary food gathering area/rohe moana from Kuri Bush to the Tokomariro River mouth, extending seaward to the limit of the South Island fisheries waters as defined under Regulation 2 of
the Fisheries (South Island Customary Fishing) Regulations 1999, and inland to boundaries defined for Te Runanga o Otakou under Te Runanga o Ngai Tahu Act 1996.
6. Appointment of Tangata Tiaki/Kaitiaki-The Associate Minister of Fisheries hereby confirms the appointments of Hoani Sydney Langsbury, Tony Ropata and Trevor Griffin as Tangata Tiaki/Kaitiaki for managing customary food gathering within these area/rohe moana. The appointments are for a term of five years commencing the day this notice comes into effect.
7. Power to authorise taking of fisheries resources for customary food gathering-The Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Acts 1983 and 1996 for customary food gathering purposes from within the whole or any part of the area/rohe moana for which they have been appointed under clause 6. No customary food gathering of fisheries resources may take place in the area/rohe moana without authorisation of a Tangata Tiaki/Kaitiaki.
