Direction in Relation to Special Benefit

Amendment 2004
To: The Chief Executive of the department for the time being responsible for administration of the Social Security Act 1964
Pursuant to section 5 of the Social Security Act 1964, the Minister for Social Development and Employment makes the following amendment to the Direction in relation to Special Benefit dated 10 February 1999.

A m e n d m e n t
1. Title-(1) This amendment is the Direction in relation
to Special Benefit Amendment 2004.
(2) In this amendment, the Direction in relation to Special Benefit is called "the direction".
2. Commencement-(1) This amendment, except for clause 4, comes into effect on 31 March 2004.
(2) Clause 4 comes into effect on 1 April 2004.
3. Consequential amendments-(1) The definition of chargeable income in clause 2.1 of the direction is amended by revoking paragraph (d) and substituting the following paragraph:
"(d) New Zealand superannuation and veteran's pension; and"
(2) The definition of living alone in clause 2.1 of the direction is amended by omitting the words "section 18A of the Social Welfare (Transitional Provisions) Act 1990" and substituting the words "section 13 of the New Zealand Superannuation Act 2001".
(3) The Schedule of the direction is amended by omitting from paragraphs 7, 13, 15 and 18 the words "or a transitional retirement benefit".
4. Schedule further amended-Each provision of the Schedule of the direction listed in the first column of
the Schedule is amended by omitting every expression set out opposite to it in the second column and substituting
in each case the expression set out opposite to it in the third column.

Explanatory Note
This note is not part of the Amendment, but is intended to indicate its general effect.
This amendment, which comes into effect on 31 March 2004, omits all references to the transitional retirement benefit wherever it appears in the direction, consequential upon the repeal of section 7A and the Fourth Schedule of the Social Welfare (Transitional Provisions) Act 1990 on 31 March 2004. It also changes a reference to the provision in which the term "living alone" is defined.
Clause 4 of this amendment amends the Schedule (relating to standard costs) to take into account a CPI increase of 1.55% and comes into effect on 1 April 2004.
