Making of a Recommendation and Assessment Concerning the Electricity Governance Rules 2003 - Rule Amendment Proposal No. 44

This notice of a recommendation and assessment concerning the Electricity Governance Rules 2003 ("Rules"), Rule Amendment Proposal No. 44, is issued by the Electricity Commission ("Commission"), established under the Electricity Act 1992 ("Act"), pursuant to section 172E (2) (c) of that Act.
Recommendation
Section 172E (2) (c) of the Act provides that, no later than 10 working days after making a recommendation concerning the Rules to the Minister of Energy ("Minister"), the Commission must publicise the recommendation and
the assessment completed under section 172F of the Act.
The Commission made a recommendation to the Minister on 10 December 2004 that:
(a) Rules 4.2 and 9.1 of section III of Part F of the Rules be amended, the defined terms "initial statement of opportunities" and "interim grid reliability standards" be inserted into Part A of the Rules, and the defined terms "statement of opportunities" and "grid reliability standards" be amended in Part A of the Rules. A copy of the assessment carried out under section 172F (1) is available on the Commission's web site; and
(b) Rules 9.7 and 17.1 of section III of Part F and the cross references in the defined terms "grid reliability standards" and "statement of opportunities" in Part A of the Rules be amended in reliance on section 172F (3) of the Act. Section 172F (3) provides that the Commission is not required to comply with section 172F (1) if it is satisfied that the effect of
the recommendation is minor and will not adversely affect the interests of any person in a substantial way. Accordingly no such assessment has been carried out under section 172F (1).
Recommended Amendments to the Rules
The recommended amendments to the Rules were:
(a) to provide for a special process for the first statement of opportunities, defined as the "initial statement of opportunities", and, as part of this process, to use a set of simplified grid reliability standards, defined as "interim grid reliability standards"; and
(b) to correct typographical and cross-referencing type errors.
