Notice of Making of Electricity Governance Amendment Rules (No. 4) 2004

1. Pursuant to section 172I of the Electricity Act 1992, I notify the amendment of the Electricity Governance Rules 2003 ("the rules") under section 172H of the Electricity Act 1992.
2. The empowering provisions for the electricity governance regulations in relation to which the rules are made are sections 172D (2) (a), (b) and (e) of the Electricity Act 1992.
3. A brief description of the nature of the amendments is:
To correct drafting errors, improve the clarity and
make further amendments to provide for intermittent generation. The following amendments to be made are:
(a) Include a table of contents for the rules;
(b) include an introduction to the rules;
(c) amend the definitions of "generating station", "embedded generating station" and "unoffered generation" in part A;
(d) remove the defined term "embedded generating unit" from part A;
(e) include the part F definitions in part A;
(f) amend the definition of "submission expiry date" in part A;
(g) add a new rule 4.6 to section III of part C:
(h) renumber the existing rule 4.6 of section III of part C as rule 4.7 of section III of part C;
(i) amend schedule D2 of part D;
(j) amend rule 3.27 of section II of Part G;
(k) add a new rule 3.2.2 of section V of part G;
(l) renumber the existing rules 3.2.2, 3.2.3 and 3.2.4 of section V of part G as rules 3.2.3, 3.2.4 and 3.2.5 of section V of part G;
(m) amend rule 3.3.2.1 of section V of part G;
(n) amend the definition of "metering situation" in part A; and
(o) update all relevant cross references.
4. These rules come into force on 22 July 2004.
5. Copies of the rules may be inspected free of charge
or purchased from the Electricity Governance Board
(also known as the Electricity Commission), Level Seven, ASB Tower, 2 Hunter Street, Wellington, or from the offices of the Ministry of Economic Development, 33 Bowen Street, Wellington.
