Under the Companies Act 1993, between David Vincent Stringer, management consultant of Wellington-Plaintiff:
And-Dacalvid Limited, a duly incorporated company having its registered office at Wellington-First Defendant:
And-David Mainland Cooke, of 30 Khouri Avenue, Karori, Wellington-Second Defendant:
Take notice that on the 19th day of September 2003, an application for an order under section 174 of the Companies Act 1993 in respect of the above-named company was filed in the High Court at Wellington.
The order sought is an order that the Dacalvid Limited
and David Mainland Cooke, company director of Wellington, pay compensation to the plaintiff and, in the alternative, an order, under section 241 of the Act, that
the company be put into liquidation, and the costs thereof.
The application is to be heard before the High Court at Wellington on the 20th day of October 2003 at 10.00 a.m.
Any person other than the defendant company, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before
that day.
The plaintiff is David Vincent Stringer, of 29 Burbank Crescent, Churton Park, Wellington, whose address for Service is care of Munro Law, Level Five, 22 The Terrace (P.O. Box 2802), Wellington.
