The applicant claims the easement is redundant by reason of the circumstances set out below. Description of Easement: Right of way over part Lot 1, D.P. 27222 (coloured yellow and marked ROW on Transfer 677267), now comprised in Computer Register WNE3/1452, created by Transfer 677267, registered on the 20th day of July 1966.
Circumstances: Part of the dominant tenement (now Lot 51, D.P. 33134, C.T. WN9D/611, owned by Redvers Properties Limited) has become physically separated from the servient tenement as a result of subdivision.
