Land and Easements Acquired for Water Supply Purposes-Youngson Road, Western Bay of

Plenty District
Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information
New Zealand, declares that, an agreement between Robert Edward Jeffrey (hereinafter called "the grantor") and the Western Bay of Plenty District Council (hereinafter called "the grantee") to that effect having been entered into, the land described in the First Schedule to this notice is hereby acquired for water supply purposes, the rights of way easements in perpetuity described in the Third Schedule hereto are hereby acquired in connection with water supply purposes over the land firstly, thirdly and fourthly described in the Second Schedule hereto, and water easements and electricity easements described in the Fourth and Fifth Schedules respectively are acquired in connection with water supply over the land secondly, thirdly and fourthly described in the Second Schedule hereto, and further declares that the said land and easements shall vest in the Western Bay of Plenty District Council on the date of publication in the New Zealand Gazette.

Third Schedule
Description of Rights of Way Easements
Right of way along with the rights and powers set out in section 6 and sections 10 to 14 of the Land Transfer Regulations 2002.
Fourth Schedule
Description of Water Easements
Right to convey water along with the rights and powers set out in section 3 and sections 10 to 14 of the Land Transfer Regulations 2002, except that the words "in common with the grantor and other persons to whom the grantor may grant similar rights" in paragraph 3 (1) shall be deleted.
Fifth Schedule
Description of Electricity Easements
Right to convey electricity along with the rights and powers set out in section 7 and sections 10 to 14 of the Land Transfer Regulations 2002, except that the words "as agreed by the grantor at the time of installation of the facility" in paragraph 7 (3) shall be deleted, and the easement facility shall be underground.
