Notice is hereby given that the Rodney District Council ("the council"), under the provisions of section 23 of the Public Works Act 1981, proposes to take the land described in the Schedule hereto ("the land").
The adjacent land has been formally designated as road
(the PENLINK roading project) in accordance with the designation decision dated 18 December 1998, subject to the Consent Orders of the Environment Court dated 27 February 2001.
The construction and subsequent operation of the PENLINK roading project is considered to be for the greater public good.
On the taking of the land for the PENLINK roading project and the construction of the road (a limited access road), it will not be practicable to provide safe and convenient access to the land referred to in the Schedule to this notice.
The owners of the land and those persons with a registered interest in it have been served with notice of the Crown's intention to take the land and advised of their right to object.
Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Department for Courts, P.O. Box 5027, Wellington, within 20 working days after the date of publication of this notice.
If any objection is made in accordance with this notice, a public hearing will be held.
The objector will have a right to appear and be heard personally unless the objector otherwise requires.
Each objector will be informed of the time and place of the hearing.
