Notice for Priority of Claims on Sale of Ships

And-The ship Om-Third Defendant:
1. The ships Osha, Orlovka and Om have been sold
and the gross proceeds of such sales, amounting to $US90,000.00 in respect of the Osha, $US200,000.00 in respect of the Orlovka and $US150,000.00 in respect
of the Om, have been paid into the Court at Christchurch.
2. The priority of the claims against the proceeds of the sales will not be determined until after 5 February 2004.
3. Any person having a claim against the ships or the proceeds of sale of any of the ships on which that person intends to proceed to judgment should commence an action to enforce that claim before the date specified
in paragraph 2 and, if necessary, apply to the Court to extend the period within which the order of priority of claims will not be determined.
4. If the steps referred to in paragraph 3 are not taken, an order determining the priority of claims against the ships or the proceeds of sale of the ships may be made without notice to the person claiming against any of the ships or the proceeds of sale of any of the ships.
