Pursuant to Regulation 90 (1) of the Traffic Regulations 1976 and pursuant to the powers delegated to me by the Director of Land Transport Safety, I, Laszlo Andras Hidvegi, Senior Engineer Safer Vehicles Policy, hereby exempt the vehicles specified in Schedule 1 of this notice from the requirements in Schedule 2, subject to the conditions in Schedule 3, until the time specified in Schedule 4.
Schedule 1
All tractors, the wheels on the rear axle of which are fitted with typical agricultural type tyres that have large, open tread pattern to provide good traction off the road.
Schedule 2
The requirement in Regulation 76 of the Traffic Regulations 1976, requiring that vehicles must be fitted, if it is reasonable and practicable to do so, with mudguards, as defined in Regulation 2 of the Traffic Regulations 1976.
Schedule 3
1. A tractor that is capable of a speed of more than 50km/h must have, fitted to its rear wheels, either:
(i) the original mudguards fitted by the tractor manufacturer; or
(ii) mudguards that provide similar or better protection against mud or water for a vehicle that follows the tractor.
2. Factory fitted mudguards stipulated above may only be modified to widen and/or lengthen them for the purpose
of providing better protection against mud or water for a vehicle that follows the tractor and/or for the tractor itself.
Schedule 4
This exemption will lapse on the day when Land Transport Rule: Vehicle Equipment (Rule 32017) comes into force.
