Pursuant to Regulation 90 (2) of the Traffic Regulations 1976, and pursuant to the powers delegated to me by the Director of Land Transport Safety Authority, I, Brent Blann, Technical Manager, hereby exempt the vehicles specified in Schedule 1 of this notice from the requirement in Schedule 2, subject to the conditions in Schedule 3.
Schedule 1
Vehicle Details
All heavy goods service vehicles where the shape of the vehicle's bodywork makes it impossible for the vehicle to comply with Regulation 59 (3) (a) of the Traffic Regulations 1976.
Schedule 2
Exempted Requirement
Regulation 59 (3) (a) Forward-facing side lamps required by this Regulation
shall be fitted at a height
from the ground not exceeding 1.5 metres in the case of
a vehicle first registered
after the commencement of these Regulations.
Schedule 3
Conditions
(i) The forward facing lamps must be fitted at a height from the ground not exceeding 2100mm.
(ii) When lit, display light substantially white or amber in colour and visible in clear weather, during hours of darkness, from a distance of 200m, through an angle of at least 15 degrees above and below a horizontal plane passing through the lamp and through angles of at least 80 degrees outboard of a vertical plane passing through the lamp parallel to the longitudinal axis of the vehicle.
