On 20 December 2002, CallPlus Limited applied under section 20 of the Telecommunications Act 2001 ("the Act") for a determination of terms on which interconnection
with Telecom's fixed public switched telephone network
non-price capped retail services offered by means
of Telecom's fixed telecommunications network and
retail services offered by means of Telecom's fixed telecommunications network as part of a bundle of retail services, must be supplied.
On 24 March 2003, the Commission issued an order
("the order"), under section 9 (6) of the Act, separating the services named in the application into those concerning interconnection and resale.
The order also makes provision for the Commission to consider both the interconnection and resale services on separate timetables, if necessary.
Pursuant to section 25 (1) (c) of the Act, the Commerce Commission gives public notice that it has decided,
under section 25 of the Act, to investigate the CallPlus Limited application for determination, insofar as it concerns interconnection with Telecom's fixed telecommunications network.
The Commission will issue a decision, under section 25 of the Act, whether or not to investigate the resale services at
a later date.
