Restoration of Company to the Register of Companies
The name of Commercial Pacific Corporation Limited
(in liquidation) 283892 was returned to the Register on the 15th day of May 2002.
It had been struck off under section 336 (3) of the Companies Act 1955 (in its pre-1 July 1994 form) on
the grounds that no liquidator was acting in its liquidation.
However, this was incorrect.
The liquidation was continuing.
The procedure commenced, under section 336, was null and void (refer Re Crott's Application (1991) 5 NZCLC 67,325), and it is proper that the Register be corrected by returning its name to the Register.
