Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information
New Zealand, declares that, pursuant to an agreement having been entered into, an easement in gross is acquired over the land described in the First Schedule (the "easement land") for the purpose of supplying electricity to the flag light on the corner of L Phillips Road and shall vest in the Crown and its successors as grantee in perpetuity on the date of publication of this notice in the New Zealand Gazette, upon the terms set out in the Third Schedule.

Third Schedule
Terms and Conditions
1. The grantee shall have the right:
(i) To forever take, convey and lead electricity reticulation in a free and unimpeded flow from the source of supply or point of entry in, along and through the easement land.
(ii) To lay, inspect, maintain, repair or re-lay electricity cable under the ground of the easement land any associated fixtures and fittings as may be reasonably required for the supply of power for lighting to the flag light on L Phillips Road.
(iii) To enter upon the servient land for the purpose
of inspecting, maintaining, re-laying, repairing, replacing or altering the electricity cabling and fixtures and fittings, as the case may be, and opening up the soil of the easement land making any cuttings, trenches and fillings, and to reopen the same, and generally to do and perform such acts or things upon the easement land as may be necessary to enable the grantee to receive the full use and enjoyment of the rights and privileges granted to the grantee.
2. The grantee will make good any damage to the servient land including, without limitation, reinstating all fencing, driveways, and areas of garden and lawns to a similar standard to that which exists immediately prior to the exercise of the grantee's rights pursuant to this easement.
