Pursuant to section 23 of the Public Works Act 1981,
notice is hereby given that the Waikato District Council
proposes to take the land described in the Schedule hereto ("the land"):
? The land is required for a public work by the Waikato District Council to form part of Coal Haulage Road
at Rotowaro.
? The intended taking is considered reasonably necessary for the continuity and safe and convenient use of an important strategic road.
? The formed proposed road is situated between 2 coal mining seams that have been mined or are being mined at present under a coal mining permit.
? The current route is the only possible route on a
stable foundation that is unaffected by mining.
? The owners of the land and those persons with a registered interest in it have been served with
notice of the Waikato District Council's intention
to take the land and advised of their right to object.
Any other person having the right to object may send
a written objection to the Registrar, Environment Court, Tribunals Division, Department for Courts, P.O. Box 5027, Wellington, within 20 working days after the service of this notice.
If any objection is made in accordance with this notice,
a public hearing will be held.
The objector will have the right to appear and be heard personally unless the objector otherwise requires.
Each objector will be advised of the time and place of
the hearing.

Schedule
South Auckland Land District-Waikato District Council
0.3810 hectares, being part Lot 1, D.P. 26226; shown as
area "E" on S.O. Plan 60952 (part certificate of title 696/61).
The land to be taken is formed and in use as Coal Haulage Road, Rotowaro, 8 kilometres from Huntly West.
A copy of the plan may be viewed at the council offices
at Ngaruawahia.
