UNITEC Institute of Technology Notice 2002

Pursuant to section 170 of the Education Act 1989, the Minister of Education gives the following notice.
N o t i c e
1. This notice may be cited as the UNITEC Institute of Technology Notice 2002, and shall come into force on the date of its publication in the New Zealand Gazette.
2. There shall be a council, to be known as the UNITEC Institute of Technology Council, which shall govern the UNITEC Institute of Technology.
3. The UNITEC Institute of Technology Council shall be constituted as follows:
(a) Four members appointed by the Minister of Education.
(b) The Chief Executive of the UNITEC Institute of Technology.
(c) One permanent member of the academic staff of
the UNITEC Institute of Technology elected by the permanent members of that staff.
(d) One permanent member of the general staff of the UNITEC Institute of Technology elected by the permanent members of that staff.
(e) One member who is or who has been a student of the UNITEC Institute of Technology elected by the students of the UNITEC Institute of Technology.
(f) One member appointed by the council, after consultation with the relevant organisation of employers, from nominations from those employer organisations listed in the First Schedule to this notice.
(g) One member appointed by the council, after consultation with the relevant organisation of workers, from nominations from those employee organisations listed in the Second Schedule to this notice.
(h) No more than five members appointed by the council, after consultation with the professional bodies which are listed in the Third Schedule to this notice and which reflect the principal areas of teaching and research within the UNITEC Institute of Technology.
(i) One member appointed by the council after consultation with the Maori Runanga of the UNITEC Institute of Technology.
(j) No more than four members co-opted by the council, each of whom shall be appointed for such term, being not less than one year nor more than four years, as may be determined by the council at the time of their appointment.
4. Unless the council is satisfied that one or more of the members appointed in accordance with clauses 3 (a) to 3 (h) inclusive can give appropriate expression to the perspectives of the Maori community, the council shall take the earliest opportunity to appoint a person so qualified in accordance with clause 3 (j), after consultation with the organisations listed in the Fourth Schedule to this notice.
5. Unless the council is satisfied that one or more of the members appointed in accordance with clauses 3 (a) to 3 (h) inclusive can give appropriate expression to the perspectives of the Pasifika community, the council shall, subject only to clause 4, take the earliest opportunity to appoint a person so qualified in accordance with clause 3 (j), after consultation with the Fono Faufautua of the UNITEC Institute of Technology.
6. Other than those persons appointed or elected pursuant to paragraphs (b), (c), (d) and (e) of clause 3 of this
notice, no person who is a permanent member of staff
of UNITEC Institute of Technology or who is a student of UNITEC Institute of Technology shall be eligible for election, appointment or co-option as a member of council.
7. The term of office of members of council, vacation of office, disclosure of members' interests and casual vacancies are covered in sections 173-176 of the Education Act 1989. Subject to section 173 of that Act, the maximum term for any member, other than the Chief Executive Officer, shall be 3 consecutive 4-year terms.
8. The UNITEC Institute of Technology Council shall have the power from time to time to add or delete organisations from the First, Second, Third and Fourth Schedules.
9. The power of the UNITEC Institute of Technology Council shall not be affected by vacancy in the membership thereof.
10. The notice constituting the Council of UNITEC Institute of Technology and appearing in the New Zealand Gazette, No. 171, 28 November 1996, page 4490, is hereby revoked.
