The name of this company was returned to the Register on the 24th day of December 2001.
Its name had been struck off the Register on the 13th day of December 2000, under section 336 (6) of the Companies Act 1955 (in its pre-1 July 1994 form), on the grounds that no liquidator was acting in its liquidation.
However, this was incorrect.
The liquidator had informed the Registrar that the liquidation had not been completed.
The procedure commenced under section 336 was null and void (refer Re Crott's Application (1991) 5 NZCLC 67,325) and it is proper that the Register be corrected by returning the name of the company to the Register.
