Pursuant to Regulation 16A (2) of the Heavy Motor Vehicle Regulations 1974, and pursuant to the powers delegated to me by the Director of Land Transport Safety, I, Laszlo Andras Hidvegi, Senior Engineer Safer Vehicles Policy, hereby exempt the vehicles specified in Schedule 1 of this notice from the requirement in Schedule 2, subject to the conditions specified in Schedule 3.

Schedule 2
1. Regulation 16A (1) (b) of the Heavy Motor Vehicle Regulations 1974, requiring vehicles to comply with the Interim Performance Specifications for Heavy Vehicle Braking.
2. The requirement to comply with the New Zealand Heavy Vehicle Brake Code that has been approved in accordance with Regulation 16A (2) of the Heavy Motor Vehicle Regulations 1974 as an alternative standard to the Interim Performance Specifications for Heavy Vehicle Braking.
Schedule 3
(i) The brake system of the vehicle must continue to comply with the Australian Design Rule 35/01.
(ii) The brake system, which is an Electronic Brake System (EBS) that also has Anti Lock Braking System (ABS) and Anti Slip Regulation (ASR) functions, must be operational within the tolerances specified by the vehicle manufacturer.
(iii) The brake system of the vehicle must not be modified in any way.
(iv) The brake system of the vehicle must be maintained as specified by the vehicle manufacturer.
(v) Any components, for example valves, sensors, relays, fittings, brake friction materials etc. that are fitted to the brake system of the vehicle during maintenance or repair, must be supplied or approved by the vehicle manufacturer.
(vi) A Statement of Compliance with the requirements in clauses (i) and (ii) above must be issued for
each exempted vehicle, identified by its Vehicle Identification Number, by the authorised agent of the vehicle manufacturer, and it must require continuous compliance with the conditions of this exemption.
(vii) The Statement of Compliance in clause (vi) above is sufficient means of verification of compliance with a set of technical requirements, alternative to the specification required in Regulation 16A (1) (b) of the Heavy Motor Vehicle Regulations 1974.
(viii) This exemption may be revoked at any time.
(ix) A copy of the Statement of Compliance in clause (vi) above, together with every relevant supporting information and documents, must be kept by the person who issued it, one copy of Statement of Compliance must be provided to the registration organisation and one copy to the operator of the vehicle.
