Under section 14 of the Reserves Act 1977, and a delegated authority from the Ministry of Conservation, the Wellington City Council notifies the following resolution was passed by the council on 6 August 1997:
"That in exercise of the powers conferred on it by section 14 of the Reserves Act 1977, the Wellington City Council resolves the land described in the Schedule (held by the council in fee simple and being part of the recreation reserve at Kingsford Smith Street), be declared recreation reserve within the meaning of the said Act.
