Pursuant to section 236 of the Public Works Act 1981, and to a delegation from the Minister of Lands, R. J. Sutherland, Land Information New Zealand, declares the land described in the Schedule to be subject to the following restriction:
Any owner of the land, the subject of the covenant, shall be prohibited from allowing any tree, shrub, hedge, building, tower, hoarding, fence, or other structure on the whole or any specified part of the land which would impede visibility across such land from either Te Ngae or Owhata Roads; provided, however, that the owner shall be entitled to maintain the canopy existing at the date of this notice, over such land supported by poles.
In addition, the pump islands, dispensers, signage and associated refuelling activity (including temporary parking for the purpose of refuelling) existing at the date of this notice shall be permitted as shall tanker delivery to underground storage tanks.
If it is necessary to replace any of the pump islands, dispensers and signage existing at the date of this notice, then the owner may replace such items but the owner shall not be entitled to allow any replacement to impede visibility across the land to either Te Ngae or Owhata Roads to a greater extent than the pump islands, dispensers and signage existing at the date of this notice impede such visibility.
