Are You a Descendant?
On 21 November 1997, the Crown and Te Runanga O Ngai Tahu entered into a Deed of Settlement, setting out the terms of the settlement reached to give effect to the claims made by Te Runanga O Ngai Tahu.
The major part of the settlement was related to the main claim on behalf of the Ngai Tahu iwi.
However, minor claims that related to individual hapu or whanau were set aside and responsibility given to a special Trust set up for the purpose to vest these minor claims in the descendants of the original owners of the land or fisheries reserves alienated in some cases over 100 years ago.
Ancillary Claim Properties
There are 32 individual claim properties, 9 of which are all based on customary fishing areas.
The total assessed value of the 32 properties is a little over $1,000,000.00, but the cultural value is of lasting significance to Ngai Tahu descendants.
Research
The Ancillary Claims Trust was established in November 1998 and, since then, the priority has been to carry out the necessary research to establish the original owners.
This research has now been completed and this notice is the first of three notices to locate the descendants of the original owners in three groups of areas.
Properties to be Vested
The claim properties are being dealt with in this first batch, are all customary fishing claims in the North and South Canterbury districts.
Please note that the following reserves are compensation lands.
They differ from the reserves of the same name found in the Maori Land Court records.
The properties below are in North Canterbury on the bank and near the mouth of the Rakahuri (Ashley) River north of Christchurch. These are often known as the Fenton Entitlements:
Waimaiaia Reserve
The land described as Canterbury Land District, Waimakariri District Council, 1.7000 hectares approximately, being part Section 3 and part Section 4 Reserve 91 (S.O. 3033). Part

Te Aka Aka Reserve

Taerutu Reserve
The land situated in Canterbury Land District, Waimakariri District, 1 hectare approximately, being part Rural Section 41888 (S.O. 16200). Part New Zealand Gazette 1956, page 718. Subject to survey within the area marked "Fenton Entitlement 3 and 4" on Allocation Plans A 421, 422, 423 and 424 (S.O. 19874).
Te Ihutai Reserve
The land described as Canterbury Land District, Waimakariri District Council, 4.0 hectares approximately, being Sections 1, 2 and part Section 4, Reserve 91 (S.O. 3033). Part New Zealand Gazette 1886 page 209. Subject to survey as shown on Allocation Plan A 200 (S.O. 19865).
Ahuriri Reserve
Situated next to Lake Te Waihora (Ellesmere) near Greenpark Flats. The land described as Canterbury Land District, Selwyn District Council, 2.0 hectares approximately, being part Reserve 959 (S.O. 8677 and S.O. 8678). Subject to survey as shown on Allocation Plan A 198 (S.O. 19863).
The following properties are situated in South Canterbury near the Waiariari (Hook) River and the Wainono Lagoon on the coast near Morven:
Te Houiri Reserve
The land situated in Canterbury Land District, Waimate District, 1 hectare approximately, being legal road (Timaru Roll 12) adjoining Te Houiri Maori Reserve 906. Subject to survey shown marked "Road" on Allocation Plan A 425 (S.O. 19875).
Pukatahi Reserve
The land situated in Canterbury Land District, Waimate District, 1 hectare approximately, being part Old Waihao Riverbed. Subject to survey as shown marked "B" on Allocation Plan A 495 (S.O. 19888).
Wainono Reserve
The land situated in Canterbury Land District, Waimate District, 1.6187 hectares approximately, being Reserve 2688 (S.O. 4399). Part New Zealand Gazette 1886, page 209, as shown on Allocation Plan A 199 (S.O. 19864).
What Happens Next?
The Trust has located names and addresses for about 70% of the likely descendants.
Letters have been sent to these people.
If a relative of yours has received a letter or if you believe your Ngai Tahu forebears lived or came from any of the above areas, and you have not received a letter, please contact us and we will send you an application for registration.
This application will show you the steps necessary to take to establish your claim.
Applications to be included in the provisional list of descendants will close on 31 January 2002.
The Trust will then complete its provisional list and write to everyone on it.
At this point, the vesting procedure will be fully explained.
