Under section 161 (6) of the Ngai Tahu Claims Settlement Act 1998, and pursuant to a resolution of the Banks Peninsula District Council dated 21 March 2001, the Conservator, Canterbury Conservancy of the Department of Conservation, declares that the roads described in the Schedule are stopped, the land is declared to be a reserve and classified as an historic reserve, subject to the Reserves Act 1977, and is vested in Te Runanga o Ngai Tahu, pursuant to section 26 of the Reserves Act 1977, as part of the Oruaka Historic Reserve.

2.28 hectares, more or less, being all that area of legal road adjoining Sections 38 and 39, Kinloch Settlement, Part Reserve 3730, Rural Section 39988 and Lake Forsyth, as shown on S.O. Plan 19893.
