Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, Stephen Robert Gilbert, Land Information New Zealand, declares, pursuant to an agreement to that effect having been entered into, that:
(a) Pursuant to sections 116 (1), 117 (3) and 117 (7), the portions of road described in the First Schedule to this notice are to be stopped and vested in the Hawke's Bay Regional Council for improvement and protection of the Tutaekuri River.
(b) Reserving pursuant to sections 20 (1) and 28, a right of way easement in gross over the land secondly described in the First Schedule to this notice vesting in the Napier City Council on the terms described in the Second Schedule to this notice.
(c) Pursuant to sections 20 (1) and 50, the land described in the Third Schedule to this notice is hereby acquired for recreation reserve and shall vest in the Napier City Council.
(d) Pursuant to section 20 (1), the land described in the Fourth Schedule to this notice is acquired for improvement and protection of the Tutaekuri River and vested in the Hawke's Bay Regional Council.
(e) Pursuant to section 116 (1), the portion of road described in the Fifth Schedule to this notice is to be stopped and which, pursuant to section 345 (3) Local Government Act 1974, shall become esplanade reserve vested in the Hawke's Bay Regional Council.
(f) Pursuant to section 20 (1), the land described in the Sixth Schedule to this notice is acquired for road and vested in the Napier City Council.
(g) Pursuant to sections 116 (1), 117 (3) and 117 (7), the portions of road described in the Seventh Schedule to this notice are to be stopped and vested in the Napier City Council as recreation reserve on the date of publication of this notice in the New Zealand Gazette.
