Pursuant to Sections 110-113 of the Insolvency Act 1967
Simon Gerard Wallbank, of Ngaruawahia, who was adjudicated bankrupt on the 12th day of February 1999, has been granted an order of early discharge by the High Court at Hamilton on the 8th day of December 2000, subject to the following conditions:
(a) The conditional discharge is for the sole purpose of allowing Simon Gerard Wallbank to apply for a student loan to complete his final year of study at the Waikato Polytechnic.
(b) All obligations, conditions, prohibitions and duties imposed upon a bankrupt and all powers vested in the official assignee, pursuant to the Insolvency Act 1967 and its amendments shall remain applicable. In particular, Simon Gerard Wallbank is prohibited from:
(i) Entering into or carrying on any business or class of business either alone or in partnership with any person.
(ii) Being engaged in the management or control of any business carried on by or on behalf of, or being in the employ of, any of the following persons, namely, the bankrupt's wife or husband, a lineal ancestor or descendant of the bankrupt, the wife or husband of such an ancestor or descendant, a brother of the bankrupt, the wife of such a brother, a sister of the bankrupt and the husband of such a sister.
(iii) Acting as a director or taking part directly or indirectly in the management of any company or class of company.
(iv) Alone or jointly with another person, obtains credit to the extent for the time being of $100.00 or more, unless he proves that, before obtaining credit to that extent, he informed the person giving the credit that he was an undischarged bankrupt; or
(v) Incurs liability to any person to the extent for the time being of $100.00 or more for the purpose of obtaining credit for another person unless he proves that, before he incurred liability to that extent to the person who gave the credit, that person was informed that the person incurring the liability was an undischarged bankrupt.
(vi) Maintaining a cheque account or applying for, obtaining or using a credit card of any nature or description.
(vii) Leaving New Zealand without first obtaining the consent of the official assignee.
The conditions shall apply until the 12th day of February 2002.
