Advertisement of Application for Putting Company into Liquidation and Other Orders

Take notice that on the 6th day of July 2001, an application for putting Kebab Place Limited into liquidation by the High Court, under section 241 of the Companies Act 1993 ("the Act") and an application for an order under section 174 of the Act, were filed in the High Court at Auckland.
The applications are to be heard before the High Court at Auckland on the 20th day of September 2001 at 11.45 a.m.
Any person, other than the defendant company, who wishes to appear on the hearing of the applications must file an appearance not later than the second working day before
that day.
The orders sought, under section 174 of the Act, are orders appointing an independent accountant to adjudicate on the sums properly payable to the shareholders and to pay out those sums upon determining the proper distribution, or an order that Kebab Place Limited be placed in liquidation; an order requiring one shareholder to pay compensation to the company or the other shareholder; and such other orders as the Court thinks fit.
The applicant is Reza Mohammad Yari, of 1/40 Haverstock Road, Sandringham, Auckland, whose address for service is at the offices of his solicitor, John Holmes, at Level Six, West Plaza Building, 3 Albert Street, Auckland.
