Pursuant to section 63 of the Casino Control Act 1990, the Casino Control Authority on 29 June 2001 resolved that the Rules of Casino Keno, Racing Game and Gaming Machines approved to be conducted and played in the licensed casinos referred to in Schedule 2 to this notice, as set out in the editions of the New Zealand Gazette referred to in Schedule 3 to this notice, be further amended as set out in Schedule 1.

Schedule 1
A m e n d m e n t s
1. Commencement-These amendments shall come into force on 1 October 2001.
2. Division I - General Rules
Part 1 - Interpretation
2.1 Part 1 of this division is amended by:
(a) deleting the definitions of "Casino Operator's Licence", "Casino Premises", "Casino Premises Licence", "Casino Supervisor", "Gaming Area" and "Keno Supervisor";
(b) inserting the following definition after the definition of "Act":
""Approved Procedures", in relation to a casino, means procedures approved by the Authority for the time being in relation to the casino;";
(c) deleting the definition of "Void" and substituting the following definition:
""Void" means:
(a) in relation to a wager, that the wager shall be invalid and shall neither win nor lose,
(b) in relation to a hand, round or keno draw, an invalid hand, round or draw with no result;"; and
(d) inserting the following definition after the definition of "Void":
""Winnings" includes any non-monetary prize won on a wager."
Part 2 - Application of Rules
2.2 Rule 2.1 of this division is deleted and the following rule substituted:
"2.1 These rules shall apply to the games described herein, and shall be binding on the casino operator and its employees and agents."
Part 6 - Disputes/Complaints
2.3 Rules 6.1, 6.2 and 6.3 are deleted and the following rules substituted:
"6.1 Complainants in all unresolved disputes shall be advised of their right to make a complaint to a Government inspector in relation to the conduct of gaming.
6.2 The casino operator shall make a copy of these rules available for examination upon request."
Part 7 - Minimum Age
2.4 This part is deleted.
Part 8 - Entry/Exclusion
2.5 This part is deleted.
Part 9 - Use of Calculators and Other Devices Prohibited
2.6 This part is renumbered as part 7. Rules 9.1, 9.2, 9.3 and 9.4 are deleted and the following rules substituted:
"7.1 No person shall, either alone or in concert with any other person, use or have in his/her possession or control, at or near any gaming machine or location related to the playing of a gaming machine, a calculator, computer, or other electronic, electrical or mechanical apparatus or device that is capable, with respect to the gaming machine or a part thereof, of interfering with the proper or normal operation of the machine or a part thereof.
7.2 Where the casino operator is satisfied that a player has contravened rule 7.1 it may:
(a) declare that any wager made by the player shall be void; and
(b) direct that the player be excluded from further participation in the game.
7.3 Rule 7.1 of this division shall not apply to possession, use or control by an agent or employee of the casino operator, a Government inspector or a member of the Police, where such person is acting in the course of his/her duty."
Renumbering of Parts 10-13
2.7 Parts 10, 11, 12 and 13 of these rules are renumbered as parts 8, 9, 10 and 11 respectively, and the rules contained in them are also renumbered accordingly.
Part 8 (previously Part 10) - Invalidation of Games
2.8 Rule 8.2 of this division (previously rule 10.2) is amended by deleting the reference to "rule 10.1" and replacing it with "rule 8.1" and deleting the reference to "rule 10.1 (b)" and replacing it with "rule 8.1 (b)".
Part 11 (previously Part 13) - Unclaimed Wagers and Winnings
2.9 Rule 11.2 of this division (previously rule 13.2) is amended by substituting the words "approved procedures" for "procedures approved from time to time by the Authority".
3. Division II - Keno
Part 2 - Equipment and Supervision of the Game
3.1 Rule 2.5 is amended by substituting the words "casino employee" for "keno supervisor".
3.2 Rule 2.6 of this division is deleted.
Part 3 - Entry and Entry Forms
3.3 Rule 3.8C (a) (i) is amended by inserting the word "ways" after the words "two or more".
Part 4 - Wagers
3.4 Rule 4.1 of this division is amended by deleting the second sentence.
Part 5 - Jackpots
3.5 Rule 5.13 of this division is deleted.
Part 7 - Closing the Game and Drawing Winning Numbers
3.6 Rule 7.7 of this division is amended by substituting the words "Two casino employees" for "A keno supervisor and a keno writer".
3.7 Rule 7.8 of this division is amended by substituting the words "A casino employee" for "The keno supervisor".
Part 8 - Winning Wagers and Payment of Prizes
3.8 Rule 8.12 of this division is amended by deleting the words ", subject to the approval of a Government inspector. The form of the Unclaimed Prize Claim Form shall be approved by the Secretary".
Part 10 - Game Closure
3.9 This part is amended by deleting the words "and to a Government inspector".
Part 11 - Irregularities
3.10 Rule 11.4 (a) is deleted and the following substituted:
"(a) if a keno ball breaks during a draw then that draw shall be declared void. A casino employee shall remove the broken ball from the device and replace it with a new ball prior to the conduct of any further draws on the device;".
3.11 Rule 11.4 (b) is amended by substituting the words "a casino employee" for "the keno supervisor".
3.12 Rule 11.4 (c) (ii) is amended by deleting the words ". The video recording of the game draw shall be examined and verified by a Government inspector before any winnings are paid on the draw".
3.13 Rule 11.5 is amended by deleting the words "and a Government inspector has been notified of the proposed
re-commencement".
3.14 Rule 11.8 of this division is deleted.
4. Division IIA - Racing Game
Part 2 - Equipment and Supervision of the Game
4.1 Rule 2.2 of this division is deleted.
Part 3 - Entry and Entry Forms
4.2 Rule 3.15 of this division is deleted and the following rule substituted:
"3.15 The casino operator may from time to time, in consultation with the Authority, reduce the number of future games available to be wagered upon below the maximum number approved by the Authority (as provided for in rule 3.5 (d) of these rules), where this is necessary due to the proposed amendment of key game parameters."
Part 11 - Irregularities
4.3 Rule 11.2 of this division is amended by deleting the words "and a Government Inspector has been notified of the proposed continuation of such gaming".
4.4 Rule 11.5 of this division is deleted.
5. Division III - Electronic Gaming Machines
Part 1 - Interpretation
5.1 Part 1 of this division is amended by:
(a) deleting the definitions of "Base Denomination", "Double Up", "Gamble", "Take Win" and "Take Score"; and
(b) inserting the following definition after the definition of "Linked Jackpot Equipment":
"A "Malfunction" means, in relation to an electronic gaming machine or associated gaming equipment, any deviation by the machine or equipment (as the case may be) from its normal operating function to the extent that a result arising from the operation of that machine or equipment could not reasonably be considered consistent with its design or expected operation, and "to malfunction" has a corresponding meaning;".
Part 2 - Equipment
5.2 Rule 2.2 of this division is deleted.
Part 3 - Operation of Electronic Gaming Machines
5.3 Rule 3.16 of this division is deleted.
Part 5 - Jackpots
5.4 Rule 5.3 of this division is deleted and the following rule substituted:
"5.3 The casino operator shall maintain a written record of all jackpots it offers, such details to include:
(a) the number and game name of each electronic gaming machine that is linked together for the purpose of providing a jackpot amount that increases progressively;
(b) the seed or reset amount of each jackpot and the percentage of turnover allocated to the seed;
(c) the incremental rate of the jackpot expressed as a percentage of machine turnover; and
(d) the maximum amount of each jackpot where applicable."
Part 6 - Rules Specific to Video Keno
5.5 This part is deleted.
Part 7 - Rules Specific to Video Poker
5.6 This part is deleted.
Part 8 - Rules Specific to Video Blackjack
5.7 This part is deleted.
Part 9 - Rules Specific to Video Spinning Reel Games
5.8 This part is deleted.
Part 6 (previously Part 10) - Irregularities
5.9 Part 10 of these rules is deleted and the following part (renumbered 6) is substituted for it:
"6.1 Subject to rules 6.7 and 6.8, the casino operator may refuse to make any prize payment to the player in respect of a wager in any case where the casino operator is satisfied that for any reason whatsoever the electronic gaming machine being played, or associated gaming equipment, has malfunctioned.
6.2 Where the casino operator refuses payment of a wager pursuant to rule 6.1, the casino operator shall:
(a) report the matter immediately to a Government inspector;
(b) ensure that the machine involved is not played or otherwise dealt with by any person until a Government inspector is afforded the opportunity to make a full examination of the machine; and
(c) refund any credit or credits wagered for the play in which the prize payment is being refused.
6.3 An electronic gaming machine shall be deemed, in the absence of it being established to the contrary, to have malfunctioned where the same hand, set of numbers or combination of symbols is displayed during three or more consecutive games on the machine.
6.4 Players are required to notify the casino operator in the event of any and all machine malfunctions. Failure to do so, and the retention of any prize or free plays as a result of machine malfunction, may be considered a contravention of these rules.
6.5 Should an electronic gaming machine malfunction while a player's credits remain displayed on the machine, the credits remaining shall be paid out manually.
6.6 In the event of a malfunction of a jackpot meter, jackpot controller or electronic gaming machine forming part of a linked jackpot arrangement, the casino operator reserves the right to adjust the value of the jackpot prize in accordance with approved procedures.
6.7 In the event that a mystery jackpot attached to a bank of gaming machines reaches its ceiling value without being triggered, the casino operator shall allocate the jackpot prize evenly among the players on the bank at the time the jackpot ceiling was reached. In the case of a mystery jackpot involving a merchandize prize, the cash equivalent of that prize shall be allocated accordingly.
6.8 In the event that a stand-alone mystery jackpot reaches its ceiling value without being triggered, the casino operator shall award the jackpot to the player on the machine at the time the jackpot ceiling was reached."
