Land Together With a Right of Way Easement

to be Acquired for a Public Work (Water Works) at Campbells Road, Makerua and Vested in the Manawatu-Wanganui Regional Council
Pursuant to sections 20 (1) and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands,
R. J. Sutherland, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for a public work (water works) and
is vested in the Manawatu-Wanganui Regional Council, together with an appurtenant right of way easement in terms of the Seventh Schedule of the Land Transfer Act 1952 over the land described in the Second Schedule hereto and such easement to be subject to the additional conditions as set out in the Third Schedule hereto on the date of publication of this notice in the New Zealand Gazette.

Third Schedule
(a) The council shall be entitled at its own cost to form and from time to time upgrade and maintain the right of way described in the Second Schedule to such a standard as is suitable to the council's requirements, provided that any such proposed work shall first be approved in writing by the registered owner of the land described in the Second Schedule, and such approval shall not be unreasonably or arbitrarily withheld.
(b) Should the registered owner of the land described in the Second Schedule or their agents be using the right of way for stock movement purposes, the council will not use the right of way until the stock are cleared from the right of way area.
