Land Together With a Right of Way Easement

to be Acquired for a Public Work (Water Works) at Okuku Road, Okuku and Vested in the Manawatu-Wanganui Regional Council
Pursuant to sections 20 (1) and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands,
R. J. Sutherland, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for a public work (water works) and
is vested in the Manawatu-Wanganui Regional Council, together with an appurtenant right of way easement in terms of the Seventh Schedule of the Land Transfer Act 1952 over the land described in the Second Schedule hereto and such easement to be subject to the additional conditions as set out in the Third Schedule hereto on the date of publication of this notice in the New Zealand Gazette.

Third Schedule
(a) The council will at its own cost repair any damage to the land, fences, water supply, drainage or other improvements contained in the balance of the land comprised and described in certificate of title 24C/564, which has been caused exclusively by the council while exercising its rights and powers under this easement.
(b) The council shall be entitled at its own cost to form and from time to time upgrade and maintain the said right of way to such a standard as is suitable for the council's requirements.
