Pursuant to sections 20 (1) and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Stephen Robert Gilbert, Land Information New Zealand, declares that an agreement to that effect having been entered into:
(a) The land described in the First Schedule hereto, is hereby acquired for a local purpose reserve (waterway), subject to the Reserves Act 1977, together with firstly the right of way easement created by transfer 363009, and secondly subject to and together with the right of way (marked "A"), right to drain water (marked "D") and right to drain sewage (marked "E") created by transfer and specified in easement certificate A. 341497.6, and shall vest in the Christchurch City Council on the date of publication hereof in the New Zealand Gazette.
(b) A right of way easement described in the Second Schedule is hereby created over the land described in the Third Schedule to be held forever appurtenant to the land described in the First Schedule hereto on the date of publication hereof in the New Zealand Gazette.

Second Schedule
Description of Right of Way Easement
The full, free, uninterrupted and unrestricted right, liberty and privilege for the grantee, his servants, tenants, agents, workmen, licensees and invitees (in common with the grantor, his tenants, and any other person lawfully entitled so to do) from time to time and at all times by day and by night to go, pass and repass on foot only with light machinery and implements of any kind over and along the land over which the right of way is granted or created.
