Easement Acquired for Police, Public Safety and Emergency Services Radio Communications

and Telecommunications Purposes-Waimahora Road, Otorohanga
Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands,
R. J. Sutherland, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into and varied by agreement dated 5 September 1996, a right to operate a telecommunications easement
in gross (in common with the owner and any other
lawful users) in perpetuity, from 8 March 1995 (called "the commencement date") and for the sum of $17,500.00 plus G.S.T., is acquired over the land owned by Arthur Blair Cowan (called "the grantor"), described in the First Schedule to this notice, for the rights described in the Second Schedule, upon the terms and conditions described in the Third Schedule to this notice, and is vested in the Crown (called "the grantee") for communications for police, public safety and emergency services radio communications and telecommunications purposes on the date of publication of this notice in the New Zealand Gazette.

Second Schedule
Right to Convey Radio and Telecommunications Signals
A right to transmit and receive telecommunications and radio signals together with a right to erect such aerials, communications equipment, transmission towers, buildings and cables (including power transmission cables) necessary for such purposes (the telecommunications facility) on that part of the land shown as Section 1 on S.O. Plan 61343.
Additional Rights Included in the Easements
The right for the grantee, its agents workmen, together with any tools, implements, machinery, vehicles or equipment, of whatever nature necessary for the purpose to enter upon those parts of the land over which the easements are granted and remain there for any reasonable time, for the purpose of constructing, inspecting, cleaning, repairing, maintaining and operating the telecommunications facility subject to the condition that as little disturbance as possible is caused to the surface of the land and the surface is restored as nearly as possible to its original condition and any other damage done by reason of such operations is repaired.

Terms and Conditions
1. The registered proprietor for the time being of the
land shall do nothing on the land which may
prove prejudicial to the safe operation of the telecommunications facility.
2. The grantee shall obtain all necessary statutory or other consents associated with the construction and operation of the telecommunications facility.
3. The registered proprietor for the time being of the land shall not grow or permit to be grown any trees, shrubs or bushes or erect any improvements which will interfere with the use of the telecommunications facility.
