Under the New Zealand Walkways Act 1990, the Conservator of the Canterbury Conservancy declares the Walkway described in the Schedule has been established, to be known as the Waihao Walkway. The Waimate District Council is appointed as controlling authority for the said walkway which shall be subject to the following conditions of use:
1. No costs shall be incurred by the landowner(s) in regards to formation and maintenance of the walkway.
2. No hindrance of any undue nature shall be allowed to occur as a result of the walkway and that at a time specified the walkway shall be closed to facilitate farming operations.
3. Adequate serving and policing of the walkway by the controlling authority is undertaken.
4. A 5-year review of the terms and conditions of the walkway is undertaken by the administering authority and the landowner.
5. A programme of staggered development with regards to the formation of the total walkway route may be undertaken as agreed with the administering authority and the landowner.
6. The route to be primarily a pedestrian walk but that pedal power, cycles and horses will not be excluded provided that care is exercised.
7. Domestic animals be allowed if under control,
i.e. dogs on a leash.
8. An annual meeting be arranged with the landowner and the department's administering body to discuss issues arising.
9. All constructions/maintenance to be approved and supervised as required by the administering authority and/or the Department of Conservation as appropriate.

The easement created by transfer A. 462126.1 over Sections 1 and 2, Block V, Waitaki Survey District, contained in certificates of title 32B/677 and 32B/678; shown marked "A", "B", "C" and "D" on D.P. 72682.
