Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, R. J. Sutherland, Land Information New Zealand:
(a) Pursuant to section 20, declares that, pursuant to an agreement to that effect having been entered into, the land described in the First Schedule to this notice is acquired for conservation purposes and shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.
(b) Pursuant to sections 20 and 28, further declares that, pursuant to an agreement to that effect having been entered into, a right of way easement in gross is acquired over the land marked "D", "H" and "B" on S.O. Plan 37972, upon the terms described in the Second Schedule to this notice and is vested in the Crown.

Terms and Conditions
1. The Crown, the Crown's tenants, employees, agents, invitees, contractors and visitors shall have the full, free, uninterrupted and unrestricted right, liberty and privilege, at all times to go, pass and repass on foot, by vehicle or any other reasonable mode of transport over and along areas "D", "H" and "B" on S.O. Plan 37972.
2. Any member of the public has the full, free, uninterrupted and unrestricted right, liberty and privilege, at all times to go, pass and repass on foot, by bicycle or on horse over and along areas "D", "H" and "B" on S.O. Plan 37972.
3. Except as modified herein, the terms relating to right of ways set out in the Seventh Schedule of the Land Transfer Act 1952 and the Ninth Schedule of the Property Law Act 1952, shall apply to the easement herein.
